Re: Demand for Legally Past Due Salary to Scott A. Mayer
Gentlemen:
It has come to my attention, through the Internet, that your employer, the business enterprise "Church of Scientology" ("COS') and its Management (the "Sea Organization" and "Office of Special Affairs") have been conducting a campaign to keep the general public and, in particular, former Scientology and Sea Organization staff members from learning that those organizations were illegally paid amounts below Federal Minimum Wage requirements for their employee services, and that under the "Secret" CSI/IRS settlement agreement, COS or whatever its controlling management structure was at the time of employment of ex-staff members, is obligated to remit legally due back pay to its former staff.
As of the date set forth hereinabove, I am informed and believe that the allegations set forth above are true, and that the Sea Organization and affiliated COS entities knew and or should have known that the weekly pay allocated to me during my tenure with the Sea Organization was not in compliance with Federal Minimum Wage requirements.
Therefore, as of the date set forth above, I believe that I am entitled to claim herewith, back pay representing the difference between the actual amount I was allocated as a Sea Org member and the amount I was legally entitled to have been paid under the Federal Minimum Wage Law as a Sea Org Member from the time period in or about June of 1970 through July of 1977.
[Note: The undersigned hereby stipulates to acceptance of adjustment of payments with regard to the sums claimed herein where such adjustments are factually illustrated and backed up by legally acceptable accounting records for the actual time period that claimant was employed as a Sea Org member.]
Normal 40 Hour Work Week -- July 1970 through June 1977
Minimum Wage @ $3.50 per hour
40 hrs. x $3.50 = $140.00 per week x 364 weeks = $ 50,960.00
Overtime [4 hours per day for 5 Days -- 1 day at 12 hours
Time and a Half @ $5.25 per hour
20 hrs. at 4 hours per day. Saturdays or Sundays at 12 hours
for a total of 32 hours Overtime per week.
32 x $5.25 = $168.00 per week x 364 weeks = $ 54,432.00
TOTAL DUE AND PAYABLE $105, 392.00
[NOTE: In the interest s of a mutually satisfactory and rapid settlement, no holiday or double-time calculations have been attempted although they were obviously never paid. So long as COs acts in good faith and fair dealing in this matter, none will be introduced.]
In the interests of your employers, please forward the claim to the proper terminal in the COS for payment to me in the amount(s) specified above, and in the time allocated by the terms of the CSI/IRS Agreement, which to my knowledge and belief is thirty (30) days. Such check should be a Cashier's check in the amount set forth above or adjusted amount stipulated hereto and made payable to Scott A. Mayer, for Sea Org Back Pay and mailed to Scott A. Mayer, c/o Graham E. Berry, BERRY, LEWIS, SCALI & STOJKOVIC, One Wilshire Boulevard, 21st Floor, Los Angeles, California, 90017.
Upon receipt and successful cashing thereof, the undersigned will make no further demands upon your offices with regard to these matters. [The cashing of said check is hereby stipulated to be an acknowledgment from Scott A. Mayer, the undersigned, that any and all back payment wage claims have been paid in full and no further claims will be forthcoming.]
